The Santa Clara County District Attorney’s office on Friday filed three misdemeanor charges against Raiders linebacker Aldon Smith, stemming from an Aug. 6 incident that led to his release from the 49ers.
The three charges against Smith are:
--DUI with a prior conviction and refusal to submit to a chemical test;
--Hit and run with property damage;
--Vandalism under $400.
Smith is scheduled to be arraigned on Oct. 6. Smith faces incarceration in county jail, if convicted, according to the DA’s office.
The 49ers released Smith, 25, on Aug. 7 after his fifth run-in with the law since the 49ers selected him in the first round of the 2011 draft.
He signed with the Raiders on Friday.
Smith, a four-year NFL veteran, served a nine-game suspension to begin last season for violation’s of the NFL’s policies on substance abuse and personal conduct. His latest incident is under review by the NFL and he could face additional discipline at a later date, a source told CSNBayArea.com.
