SANTA CLARA – Outside linebacker Aldon Smith, who served a nine-game suspension this season for violations of the NFL’s policies on substance abuse and personal conduct, stated Tuesday he was not drinking at Ray McDonald’s house last week.
“As far as it’s concerned, I was over at Ray’s house for close to an hour,” Smith said. “I didn’t drink one thing. And as far as it goes, relating to that, I have nothing else to say. It’s not my issue or my problem.”
Smith was named in a search warrant affidavit released by the courts on Monday. McDonald is under investigation as a suspect in a sexual assault investigation. The day after the reported incident, the alleged victim said she remained at McDonald’s house when Smith came to visit. Smith is not accused of any crime.

The summary of the current investigation reads: “…one of his friends showed up by the name of Aldon Smith. She stated that the three of them went to the store and bought some vodka and cranberry juice and started drinking again at his house and remained there until later in the night.”
After visiting McDonald, Smith said he spent time with his son. Smith said he is tested regularly. When asked how often, he answered, “Enough for me to pass the test.”
In July, a Santa Clara County Superior Court judge sentenced Smith to three years probation after pleading “no contest” to weapons and DUI charges.
